Die Autorin untersucht den derzeitigen Gesetzgebungsstand in den am wenigsten entwickelten Mitgliedstaaten der WTO. Dabei zeigt sie, dass diese Länder von der Umsetzungsfrist des Art. 66 Abs. 1 des Übereinkommens über handelsbezogene Aspekte der Rechte des geistigen Eigentums (TRIPS) in Hinblick auf die patentrechtlichen Vorgaben kaum Gebrauch gemacht haben. Darüber hinaus folgt aus der Auslegung des Art. 66 Abs. 1 TRIPS, dass die Umsetzungsfrist Folge des welthandelsrechtlichen Grundsatzes der bevorzugten Behandlung der am wenigsten entwickelten Länder ist. Sie soll dazu dienen, den Technologietransfer zu fördern.
