Das Konzernprivileg ist ein im Rahmen des Kartellverbots anerkanntes Prinzip. Die Verbundenheit von Unternehmen zu einer wirtschaftlichen Einheit führt zur Nichtanwendbarkeit des Artikels 101 AEUV im Innenverhältnis. Die Autorin untersucht, ob dieses Prinzip auch auf Artikel 102 AEUV, insbesondere beim Diskriminierungs- und Behinderungstatbestand, anzuwenden ist. Sie befasst sich zunächst mit dem Begriff der wirtschaftlichen Einheit, der Herleitung des Konzernprivilegs und zieht Parallelen zum deutschen Kartellrecht, wo das Konzernprivileg auch auf den Missbrauchstatbestand des § 19 GWBAnwendung findet. Im Ergebnis spricht sich die Autorin für eine entsprechende Praxis im europäischen Kartellrecht aus und erarbeitet Grundsätze für die praktische Umsetzung.
