Die Anwendungskonkurrenz zwischen Investmentsteuerrecht und Hinzurechnungsbesteuerung wird aktuell wieder kontrovers diskutiert. Der Autor empfiehlt eine Anwendung der Hinzurechnungsbesteuerung auf ausländische Investmentfonds und ihre inländischen Anleger. Dem liegt eine Untersuchung der Systemgerechtigkeit des § 7 Abs. 7 AStG zugrunde. Diese basiert auf einer Analyse beider Rechtsgebiete sowie der ihnen zugrunde liegenden Prinzipien. Maßstäbe sind dabei das Europa- und Verfassungsrecht sowie die einfachgesetzlichen Prinzipien des reformierten Investmentsteuerrechts und der Hinzurechnungsbesteuerung. Dem Regelungsimpuls der Anti Tax Avoidance Directive (ATAD) folgend entwickelt der Autor einen Reformvorschlag für eine systemgerechte Ausgestaltung des Konkurrenzverhältnisses.
