In der aktuellen eigentumspolitischen Diskussion gibt es Vorschläge, die darauf hinauslaufen, den personalen Bezug des Eigentums erheblich zu relativieren und die Privatnützigkeit des Eigentums zu marginalisieren oder gar auszuschließen. Genannt seien etwa Vorschläge zur Einführung eines Modells einer Gesellschaft mit gebundenem Vermögen oder auch Ideen, der Natur eine eigene Rechtssubjektivität gesetzlich einzuräumen. Dabei stellt sich allerdings die Grundsatzfrage, inwieweit ein solches Eigentumsbild mit dem Eigentumsverständnis des Grundgesetzes überhaupt kompatibel ist. Angeleitet von der übergreifenden Frage nach einem „Eigentum ohne Eigentümer?“ setzen sich die Autorinnen und Autoren mit diesen Themen aus unterschiedlichen Blickrichtungen auseinander und diskutieren verfassungsrechtliche, rechtshistorische und ideengeschichtliche Aspekte. Dies ist ein Open-Access-Buch.
