In diesem Buch wird die Bedeutung professioneller Kooperation juristischer Akteure in Gerichtsverfahren mit Hilfe qualitativer Methoden untersucht. Vor dem Hintergrund einer pragmatistischen Theorie sozialer Praxis arbeitet Sebastian Starystach Kernmerkmale der professionellen juristischen Fallbearbeitung in Straf- und Zivilverfahren an Amts- und Landgerichten heraus. Der Autor rekonstruiert systematisch die prozessbeteiligten Rollen von Richtern, Staats- und Rechtsanwälten und nimmt zugleich ihr Zusammenwirken im Kontext der Fallbearbeitung interaktionistisch in den Blick. Das Ergebnis ist die Freilegung des Kerns professionellen Handelns in den betrachteten Verfahrensformen. Es zeigt sich dabei, dass sich die juristischen Akteure weit über den formalen Rahmen der jeweiligen Prozessordnung hinaus an informellen Handlungsweisen orientieren.
